PERSONAL DATA CHARTER

PRESENTATION
The I'Car Systems Group including the I'CAR SYSTEMS GROUPE company, Société par Actions Simplifiée, registered in RCS of Tours with the No: 791 960 693, Head Office in 8/12 rue Fabienne Landy 37700 Saint-Pierre des Corps as well as all its existing and future subsidiaries held over 50%, are responsible, ethical and civic software package publishers, which share their values and commitments with their staff and partners (hereinafter the "Company").

Because the Company, within the scope of its activity development, cares about the personal data protection of its customers, prospects and more broadly any person with whom it interacts, it wanted to implement a charter related to personal data.

This charter aims at presenting the commitments applied by the Company to all people customers or prospects concerned by the processing of their personal data (hereinafter "Charter").

Through this Charter, the Company commits to ensure the private sphere and personal data protection, confidentiality and security, with due compliance to the French and European applicable laws and to the recommendations issued by the G29.

It also informs you about your personal data collection and use processing and about the options available to you in this respect.

The applicable version of the Charter is the one available in the Company internet site at the time of your access. The present Charter may evolve and be regularly updated particularly with regard to possible law or regulation evolutions. On this basis prior to any browsing we invite you to refer to the last version of the online Charter.


ARTICLE 1
WHY ARE YOUR PERSONAL DATA COLLECTED BY THE COMPANY?

First the Company is a Data Controller as defined under the Law "Informatique & Libertés" and as such, collects and processes personal data.

This data are required particularly to enable you to access the offers and services it sells, to process your software and service purchases, and to enable you to discover its new software and services, according to your wishes.

Within the scope of the maintenance and services it supplies, all personal data are processed by the Company in compliance with applicable terms and conditions and particularly with the articles related to personal data processing.


ARTICLE 2
WHICH OF YOUR PERSONAL DATA ARE COLLECTED BY THE COMPANY?

We collect declaration data and behavioral data (hereinafter taken together as "your Personal Data").

Declaration data: the Company may build one or several files including information that you willingly supply to it to benefit from a software or service offer. These Personal Data are mainly collected when you place an order, or during any merchandizing, e.g. game, survey, etc. irrespective of the medium, e.g. telephone, e-mail, etc. These data generally are your identity and your contact data, e.g. mail and/or e-mail address, telephone number.

You may be asked if you would like to receive the Company sales offers. When your declaration data are thus used for commercial purpose, you will be asked for your consent where required, in compliances with current regulations.

Behavioral data: the Company may also collect your browsing data via data collection tools (cookies, IP address, and any other appropriate mean) installed in the company website (hereinafter "Tools").

These data are required to realize overall statistics surveys about our site audience, identify you where the case arise, adapt the content of a service or offer sold by the Company to your behavioral data and, more broadly, study your behavior when you browse the site in order to offer you a better browsing experience.

However, you may choose to disable the Tools via your internet browser. In which case, site browsing may change or even become impossible. We therefore advise to enable the Tools to fully beneficiate from browsing our sites.

During each of your access, these Tools allow for realizing overall statistics surveys about our site audience, for identifying you where the case arise, for adapting the content of a service or an advertised offer to your behavioral data and, more broadly, for studying your behavior when browsing the Site so as to offer you a better experience of browsing and use of our Services.


ARTICLE 3
CONFIDENTIALITY AND SECURITY

Personal Data collected by the Company are under no circumstance sold, rented or exchanged to third parties, with the exception of its subsidiaries, unless it was clearly specified when collecting the concerned data, or without informing you and without receiving your prior consent.

The Company may have to disclose your personal data, without your prior consent, only in cases where:

- The Company purchases another company or is subject to buyout, merger, absorption, consolidation, or reorganization of any kind.

- The transmission of which is requested by a competent authority in accordance with applicable regulations.

Also, the Company undertakes its best efforts to ensure your Personal Data protection particularly with regard to unauthorized third parties and implements, both when defining the processing means and when processing, the appropriate technical, security, and organizational measures. The Company commits to implement measures that consist in limiting and confining by default the personal data processing strictly to the purposes pursued by this processing.

Any Personal Data breach shall be notified to the person concerned in accordance with applicable regulations.


ARTICLE 4
COOKIES

A cookie is a small data file copied in your computer hard drive by a website. It records information related to your computer when browsing a website, e.g. browsed pages or browsing dates and times, which may be read when you later browse the Company website. The Company may send cookies when you browse the website or when you are using software packages for which you acquired use rights.

The cookies or tools implemented in the Website are of different types for different purposes:

- First Party Cookie: stores personal or pseudo/ano-nymized data that may read your website only.

- Third Party Cookie: usually stores pseudo/ano-nymized data with a content that may be accessed by third parties.

- Media or Retargeting Script: creates third party cookies and tracing by collecting as much user data as possible.

- Client/browser side tracing system: collects personal data, e.g. Google Analytics

- Server side tracing system: collects personal data, log files or server tracing via GA measurement protocol.

The Company website uses Google Analytics, a website analysis service supplied by Google Inc. ("Google") which within the scope of this service is allowed to locate cookies in our website.

The data created by the cookies about your use of the Website (including your IP address) are sent and stored by Google in servers located in the European Union. Google shall use this information to assess your use of the Company website, to compile activity reports intended to the Company and to supply other services related to the website activity and to the internet use. Google may communicate these data to third parties in the case of a legal obligation or when these third parties process these data on behalf of Google, including particularly this website publisher. Google shall not cross-check your IP address against all the other data held by Google. You may disable the use of cookies by selecting appropriate settings in your browser. RETENTION PERIOD AND HOSTING

The data are stored in the European Union in the website hosting company the address of which shows in the website legal notices, and are kept for a duration strictly limited to the needs of the fulfilment of the above-mentioned purposes. Beyond this duration they shall be retained for statistics purposes only and shall be subject to no use of any kind.

RIGHTS TO ACCESS, OF RECTIFICATION, TO OBJECT, AND TO PORTABILITY RELATED TO YOUR PERSONAL DATA

According to the provisions of the articles 13 to 21 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement on such data, so-called GDPR, you may request that your Personal Data are communicated to you and demand that are, depending on the circumstances, rectified, completed, updated, locked or deleted your Personal Data, which are inaccurate, incomplete, outdated, or the collection, the use, the communication or the retention of which is prohibited.
